Decree 98/2013. (X. 24.) of the Minister of Rural Development on the breeding rules of purebred dogs
Based on the authorization received in points 2., 3., 8., 13. subpoints of paragraph a) of section 49 (1) of Act CXIV of 1993 on Animal Breeding, as well as in point 7. subpoint c) of paragraph (1) of section 100 of Act LV of 1996 on Wildlife Protection, Wildlife Management, and Hunting – acting within my competence as defined in points a) and i) of section 94 of Government Decree 212/2010. (VII. 1.) on the tasks and powers of certain ministers and the state secretary leading the Prime Minister's Office – I decree the following:
Section 1 (1) The purpose of the regulation is to create and maintain a healthy, pedigree-registered dog population with breed characteristics compliant with international regulations. For this purpose, maintaining dog breeds, pedigree registration, performance determination, collecting, recording, processing breeding data, and issuing breeding documentation can be performed under the conditions specified in this decree.

(2) This decree shall apply to the breeding activities of breeding organizations and the cynological association.
Section 2 For the purposes of this decree:
1. kennel name: the unique name of the breeder’s dog breeding establishment issued and registered by the cynological association;
2. cynological association: the association designated by the minister responsible for agricultural policy representing Hungarian dog breeders’ interests and international representation;
3. export pedigree certificate: a public document issued based on the pedigree book containing the breeding data of the breeding animal and reproductive material, serving to certify the international origin of the dog;
4. dog show: an event related to dogs where no breeding data is generated;
5. breeding dog: an individually identifiable dog, kept in its sex, marked with an identification number or sign, registered, and appearing in the pedigree registry of the recognized or temporarily recognized breeding organization (hereinafter collectively: breeding organization);
6. breeding dog exhibition: an event featuring one or more breeds or all breeds involving dog handling, conformation judging, and/or working performance demonstrations, where breeding data subject to pedigree registration is generated;
7. breeding: all targeted activities aimed at increasing the breeding and utility value of a given breed or preserving its genes;
8. breeding data: registered data of individuals of dog breeds subject to this decree, especially data relating to individual identification, location, origin, conformation, performance, breeder and owner, litter and full siblings.
Section 3 (1) Only breeding organizations are entitled to maintain dog breeds, perform pedigree registration, determine performance, collect, record, process breeding data, and issue breeding documentation unless otherwise provided by this decree. The breeding organization may entrust others with specific technical tasks while retaining responsibility.
(2) Only one breeding organization may be recognized per breed. Within a breed group, one organization may obtain breeding organization recognition for multiple breeds.
(3) If breed maintenance cannot be assured otherwise, one organization may receive breeding organization recognition for multiple breeds.
(4) The organization operating as a breeding organization must ensure that ordinary members are exclusively individuals who own at least one registered individual in a breed belonging to the breeding organization. Membership cannot be denied to those applying who meet the membership requirements. The organization operating as a breeding organization must conduct the membership admission procedure without delay.
(5) The procedure for breed recognition is part of the breeding organization recognition procedure.
Section 4 (1) The tasks of the organization operating as a breeding organization, in addition to those specified in section 19 (1) of the Animal Breeding Act CXIV of 1993 (hereinafter: Animal Breeding Act),
a) issuing pedigree certificates, and
b) providing data required by law to the breeding authority.
(2) The organization operating as a breeding organization shall carry out its activities so that through omission – including failure to fulfill obligations arising from international organizational membership – it does not cause disadvantage to its members.
(3) The breeding organization has the exclusive right to represent the breed listed in the recognition in the international organization of the breed, and the cynological association has the exclusive right to represent the entirety of domestic cynology in the international cynological organization, taking into account the provisions of the regulations of the given organization.
(4) The breeding organization concerned, in cooperation with the cynological association, shall ensure the training and examination of judges conducting the breed performance tests.
Section 5 (1) The tasks of the cynological association are:
a) representing Hungarian dog breeders and their breeding organizations in international professional organizations;
b) organizing and coordinating dog shows and - considering the provisions of Section 13 - breeding dog exhibitions;
c) participating in the training and examination of judges, registering judges in the international judges' list, maintaining and publishing the Hungarian judges' list;
d) delegating judges to multi- and all-breed breeding dog exhibitions from the group of judges pre-designated by the breeding organization;
e) organizing the judging of breeds within multi- and all-breed breeding dog exhibitions, in consideration of international professional rules, for breeds without a recognized breeding organization in Hungary;
f) standardizing the recommended pedigree certificate format, and preparing and providing forms for breeding organizations;
g) issuing kennel names and initiating their registration with the international organization;
h) issuing export pedigree certificates for dogs intended for export, based on the breeding organization’s studbook, and
i) in the case of breeds without a breeding organization, carrying out breeding organization tasks based on the assignment by the breeding authority.
(2) The organization operating as a cynological association must ensure that a decision is made on the breeding organization's membership application within 30 days from receipt of the application. The organization operating as a cynological association is obliged to admit breeding organizations as members under equal conditions.
(3) The organization operating as a cynological association, in representing Hungarian dog breeding in international organizations, must ensure the equality of breeding organizations with regard to rights and obligations.
(4) The organization operating as a cynological association must ensure in its statutes that in breeding matters, in the creation of internal regulations concerning these, and in their international representation, only breeding organizations with membership shall decide. The organization operating as a cynological association must ensure that breeding organizations have equal voting rights.
(5) The cynological association is obliged to accept studbooks, pedigree certificates, and performance tests issued by member breeding organizations if they comply with this regulation’s provisions and those of the international organization of which the cynological association is a member.
Section 6 (1) The cynological association shall be designated by the minister responsible for agricultural policy upon application, for an indefinite period. In the case of multiple applications, no legal effect is attached to the order of receipt.
(2) The application referred to in paragraph (1) must include
a) the name, address, name of the representative, statutes, and an authenticated copy of the court registration of the applicant;
b) a description of the applicant’s activities, and
c) a list of the applicant’s member organizations (name, headquarters, and number of the recognition decision).
(3) The minister responsible for agricultural policy shall revoke the designation of the cynological association if
a) the cynological association requests it, or
b) it does not carry out its activities in accordance with the laws, international professional rules, statutes of international organizations, or the contents of its application.
(4) In the case specified in paragraph (3), until the designation of a new cynological association, the services specified in Section 5 shall be performed by the breeding organizations under the coordination of the breeding authority.
(5) The breeding authority shall notify the breeding organizations of the revocation of the designation of the cynological association and the new designation within 30 days following the revocation or designation.
(6) The new cynological association shall provide the services set forth in Section 5 to the breeding organization submitting the membership application during the membership admission procedure.
(7) In the event of revocation of designation of the cynological association or its cessation without legal successor, the breeding data managed by it must be handed over immediately to the breeding authority.
(8) The revocation of the designation of the cynological association does not affect the recognition of the breeding organizations with membership rights.
Section 7 (1) The breeding authority is authorized to recognize breeding organizations and to revoke such recognition. Granting or denying recognition does not affect the lawful operation of the organization under other laws.
(2) The breeding authority shall recognize an organization engaged in breeding as a breeding organization if, in addition to the conditions set out in Section 20 (2) of the Átv.,
a) its members have at least 10 female breeding dogs of the requested breed;
b) its articles of association stipulate that ordinary members can only be persons who have at least one individual registered in the breed belonging to the breeding organization;
c) its articles of association ensure that all persons who keep or breed dogs registered or registrable in the studbook of the breed belonging to the breeding organization may join the given breeding organization without restrictions or delays and exercise their membership rights;
d) it ensures equality of members and does not apply delegate general meetings in its decision-making procedures, and
e) its ordinary member is a member of the cynological federation, or in the event of designation of a new cynological federation, proves membership in the new cynological federation within 75 days following the designation.
(3) The breeding authority shall obtain the opinion of the National Hungarian Hunting Chamber regarding the breed groups and breeds specified in subsection (4). The National Hungarian Hunting Chamber is obliged to communicate its opinion to the breeding authority within 30 days. The opinion deadline cannot be extended. The opinion of the National Hungarian Hunting Chamber is not binding on the breeding authority.
(4) In the procedure for recognition as a breeding organization, the breeding authority shall request the opinion of the National Hungarian Hunting Chamber for the following breeds subject to working examination:
a) among hounds, the Hanoverian hound and the Bavarian mountain hound;
b) among English pointers, the pointer, the English setter, the Irish setter, and the Gordon setter;
c) among Continental pointers, the short-haired Hungarian vizsla, the wire-haired Hungarian vizsla, the short-haired German pointer, the wire-haired German pointer, the rough-haired German pointer, the long-haired German pointer, the Weimaraner, the large Münsterländer, the small Münsterländer, the Italian pointer, the wire-haired griffon, the poodlepointer, the Czech wire-haired pointer, and the Brittany spaniel;
d) among flushing dogs, the German spaniel, the English springer spaniel and the English cocker spaniel;
e) retrievers;
f) dachshunds, and
g) among sighthounds, the Hungarian greyhound.
Section 8 (1) The application for recognition as a breeding organization must be submitted to the breeding authority.
(2) The application shall include
a) the name, seat, and representative's name of the organization requesting recognition;
b) the number of members of the applicant;
c) the breed or breeds intended to be bred;
d) the number of registered living individuals by breed;
e) breeding data recorded in the applicant's register on the individuals, the name of the breeders of the dogs, and the place of keeping the dogs, and
f) the personal and material conditions, including the name and data of the breeding manager.
(3) The application must be accompanied by
a) the pedigree certificate sample coordinated with the cynological federation, stamped, or the declaration on using the recommended pedigree certificate form provided by the cynological federation;
b) the signature specimen of the person authorized to sign the pedigree certificate;
c) an authentic copy of the approved articles of association;
d) an authentic copy or extract of the court registration regarding the social organization's court records;
e) a copy of the certificate proving the breeding manager's higher education qualification as prescribed in this legislation;
f) a certificate from the cynological federation on the existence of the membership relationship, and
g) the breeding program for each breed, in printed or electronic form.
(4) The breeding program shall include
a) the description of the breed;
b) the breeding objective;
c) the breeding method, the typical and recommended housing method for the breed;
d) the studbook regulations (the framework rules for registration are contained in Annex 1);
e) the performance testing regulations (the framework rules for performance testing are contained in Annex 2);
f) the classification system for breeding males;
g) the rules for inclusion in breeding, including in particular the minimum and maximum age limits for inclusion and retention in breeding, the interval between two litters, the number of offspring to be registered per litter, as well as the lifetime performance;
h) the rules for registration, identification, and certification;
i) the method of marking the dogs;
j) the method and documentation procedure for litter inspection and pedigree verification, and
k) the obligations and regulations related to examinations suitable for screening hereditary diseases.
Section 9 (1) Based on the pedigree data submitted in the application, the breeding authority verifies the existence of live individuals during the recognition procedure.
(2) If the applicant cannot ensure the number specified in Section 7 (2) point a), the breeding authority may grant temporary recognition to the applicant for up to three years.
(3) The breeding authority shall make a decision on the recognition or the rejection of the application for recognition.
Section 10 (1) The breeding organization regulates in its breeding program the provisions regarding the provision of an environment necessary for the appropriate physical and mental development of puppies, as well as the formation of their desirable relationship to humans.
(2) Unless the breeding program sets stricter rules, a maximum of 9 litters per person can be registered in one calendar year in one kennel.
Section 11 (1) The breeding organization is obliged to carry out or have carried out the performance test for all breeding dogs of breeders who request it, and to register the dog and provide it with a pedigree certificate, if it belongs to the breed listed in the recognition of the breeding organization, there is no professional obstacle to the registration, and the breeder accepts the breeding program of the given breed.
(2) The breeder is entitled to the breeding rights arising from membership in international professional organizations represented by the breeding organization or the cynological federation, provided the conditions set out in paragraph (1) are met.
(3) The breeding organization is obliged to accept pedigrees, pedigree certificates, performance tests, and international titles approved by the previous breeding organization of the breed, organizations accepted by the contracting states of the European Economic Area, or international organizations, as well as international judge ratings acquired prior to the entry into force of this regulation.
Section 12 Performance tests may only be performed by persons accepted by the breeding organization and listed in the panel of judges.
Section 13 (1) A single-breed breeding dog show can be organized by the breeding organization recognized for the maintenance of the given breed, multi-breed breeding dog shows can be organized jointly by the given breeding organizations. The event must be reported to the breeding authority at least 15 days before its start.
(2) The cynological federation may also organize breeding dog shows – taking into account the provisions of paragraph (5). The event must be reported to the breeding authority at least 15 days before its start. The notification must include which breeds will participate in the show.
(3) The breeding authority publishes the time, place, and range of participating dog breeds of the breeding dog shows on its website.
(4) Permission from the breeding authority is not required for events that are not classified as breeding dog shows, such as dog shows. The event must be reported to the breeding authority at least 15 days before its start.
(5) Breeding data only arises at events organized by a breeding organization not recognized for the maintenance of the given breed if that breeding organization has previously declared acceptance of it. If, in relation to a dog show, the breeding organization recognized for the maintenance of the given breed declares in advance acceptance of the event as a performance test, the event must be considered a breeding dog show concerning that breed.
Section 14 Breeders are obliged to properly take care of the keeping, care, and health care of their old, sick, or otherwise non-breeding animals.
Section 15 The provisions of Section 168 of Act C of 2000 on accounting shall apply to pedigree certificates and export pedigree certificates for dogs.
Section 16 (1) The breeding authority randomly checks the records kept by the breeding organization and the performance tests, reviews the activities of the breeding organization, and if no deficiencies are found during the inspections and review, the authority considers the pedigree data authentic.
(2) The breeding authority may check whether the cynological federation complies with international professional rules with regard to breeders.
Section 17 The breeding authority shall publish the list of breeding organizations on its website.
Section 18 (1) The duration of the suspension under Section 23 (1) of the Átv. is up to 90 days. If the breeding organization does not fulfill the prescribed conditions during the suspension period, the breeding authority shall revoke the recognition of the breeding organization.
(2) The breeding authority shall revoke the recognition
a) failure to comply with the conditions set out in Section 7 (2),
b) operation, data collection, and false data reporting that do not comply with legal requirements or the contents of the recognition application,
c) obstruction of the inspection,
d) refusal to provide data, or
e) failure to report data changes.
(3) The breeder organization's recognition ceases if the breeder organization is dissolved without legal successor.
(4) In the event of the breeder organization's dissolution without legal successor, or the revocation of recognition, until the recognition of a new breeder organization, or in the case of breeds without a recognized breeder organization, the breeding authority or an organization authorized by it and suitable for the task shall fulfill the breeder organization duties.
Section 19 (1) The breeder organization is obliged to notify the breeding authority of any changes to the data specified in Section 8 (2) within 15 days.
(2) The cynological association is obliged to notify the minister responsible for agricultural policy of any changes to the data specified in Section 6 (2) within 15 days.
Section 20 (1) The breeder organization employs a breeding manager to implement the recognized breeding program.
(2) The breeding manager must have higher education in agriculture, forestry, wildlife management, veterinary medicine, or biology.
(3) In case of changes to the statutes, the head of the breeder organization is required to submit a copy of the court decision approving the registration to the breeding authority within 15 days after receiving it.
Section 21 Breeder organizations are obliged to upload copies of issued pedigree certificates into the national electronic database according to Section 42/A of Act XXVIII of 1998 on the Protection and Humane Treatment of Animals.
Section 22 This regulation shall enter into force the day after its promulgation and shall apply to ongoing cases as well.
Section 23 On the 15th day following the entry into force of this regulation, the cynological association designated under Government Decree 64/1998 (XII. 31.) on the breeding rules of purebred dogs shall cease to be designated, and it must transfer the breeding data it manages to the breeding authority without delay within 3 days following its cessation.
Section 24 (1) Within 60 days following the entry into force of this regulation, the breeding authority shall call on the breeder organizations to submit the documents specified in Section 8 (2) and (3) within 90 days.
(2) The breeding authority shall revoke the recognition of the breeder organization if the breeder organization fails to fulfil the obligation referred to in paragraph (1), or if the submitted documents do not comply with the provisions of this regulation.
(3) The provisions of Section 6 (4)–(6) shall also apply to the tasks of the cynological association and the notification of the breeder organization.
Section 25 This regulation serves to establish the breeding technical and pedigree requirements for the marketing of purebred animals, and to ensure compliance with Council Directive 91/174/EEC of March 25, 1991, amending Directives 77/504/EEC and 90/425/EEC.
Section 26 The provisions of Government Decree 64/1998 (XII. 31.) on the breeding rules of purebred dogs shall be repealed.

Annex 1 to Government Regulation 98/2013 (X. 24.) VM
Rules for the maintenance of the studbook and the issuance of pedigree certificates for purebred dogs
I. Rules for maintaining the studbook
1. Only one studbook may be kept for a breed.
2. Contents, structure, and maintenance of the studbook
2.1. The studbook shall contain at least the following data for each registered dog:
2.1.1. the name and address of the breeder and the owner;
2.1.2. the date of birth of the dog;
2.1.3. the dog's name, sex, identifier, and characteristics;
2.1.4. the names, identifiers, characteristics, breeding evaluations, and performance test results of the dog's parents, grandparents, and great-grandparents;
2.1.5. all performance test results known to the breeder organization;
2.1.6. the date of elimination and, if known, the reason for it;
2.1.7. the dates and purposes of issued or delivered breeding certificates.
2.2. The studbook must include a main section (hereinafter: main studbook section). The studbook may include a supplementary section (hereinafter: supplementary studbook section) at the discretion of the breeder organization.
2.2.1. Dogs may be entered in the main studbook section if they meet all breeding evaluation criteria based on their own performance, and their parents and grandparents are registered in the main studbook of the same breed.
2.2.2. The breeding organization managing the studbook may decide to open an auxiliary studbook section for individuals not meeting the conditions of point 2.2.1. In this case, the relationship between the main and auxiliary studbooks must also be regulated. For registration in the auxiliary studbook, the individuals must meet:
2.2.2.1. the identifiability according to the rules established in the studbook;
2.2.2.2. the breed’s exterior characteristics;
2.2.2.3. the performance test conditions defined in the breeding program;
2.2.3. the registration may apply to dogs which
2.2.3.1. belong to the breed but have unknown origin;
2.2.3.2. are part of the crossbreeding program approved by the breeding organization.
2.2.4. The auxiliary studbook may contain classes separated according to the dogs’ performance. The classification must be carried out according to the conditions set out in the studbook regulations.
2.3. The form of the studbook may be: a book, list, card index, or other data carrier that can be authenticated.
2.4. The studbook can be kept at the breeding organization or, on its behalf, at the data processing institution, and cannot be discarded.
2.5. A pedigree certificate can only be issued based on the auxiliary studbook with an indication of this fact.
3. The studbook regulations must detail:
3.1. the reporting of breeding dogs and the offspring necessary for the breeding program within a specified deadline;
3.2. the reporting of mating and insemination dates and whelping dates to the breeding organization within a specified deadline;
3.3. the preparation of necessary primary documents at the breeder for studbook entry, regarding the identification, description, origin of the breeding dogs, and dates of mating and whelping;
3.4. the method of pedigree verification;
3.5. the reporting of changes in ownership;
3.6. the assumption of responsibility for marking, required reports, records, and registrations;
3.7. the procedure for providing data to the cynological association.
II. Regulations for issuing the pedigree certificate
1. The pedigree certificate must contain at least:
1.1. serial number;
1.2. name of the breeding organization, name of the studbook, and classification;
1.3. dog’s date of birth, breed, and sex;
1.4. the method of marking the dog, individual identification, distinguishing marks, and studbook number;
1.5. name and address of the breeder and owner;
1.6. the dog's origin at least up to the grandparent generation, including the ancestors’ studbook numbers;
1.7. evaluation of the dog and its parents and grandparents, including any time restrictions;
1.8. place and date of issuance;
1.9. signature of the person responsible for the professional work and the stamp of the breeding organization;
1.10. performance tests.
1.11. The performance tests and their results according to point 1.10. may also be contained in the performance test book accompanying the pedigree certificate. In this case, the serial number of the performance test book must be indicated on the pedigree page.
2. The pedigree certificate must always be available at the location where the breeding dog is kept.
3. A duplicate of the pedigree certificate can be issued by the issuer with the original serial number indicated. The reason for issuing the duplicate and the date of issuance must be noted on the duplicate. The issuance of the duplicate must be registered.
Annex 2 to Regulation 98/2013. (X. 24.) of the Ministry of Agriculture
Rules for performance testing of purebred dogs
1. When compiling the regulations, the requirement system of the breed’s country of origin must be taken into account.
2. The performance testing regulations must include at least the following:
a) rules for performance testing appropriate to the breeding goal (appearance, working performance);
b) exhibition regulations;
c) the order of evaluations and examinations, rules for appointing judges, the order of achievable titles and awards;
d) competition regulations;
e) personal conditions of those conducting the performance tests;
f) breeding dog exhibition and working test regulations developed on the basis of internationally accepted guidelines;
g) operational rules of the judging panel, qualifications system for judges, judges’ responsibility;
h) for breeds competing in working tests, the qualification requirements for assistants participating in the performance test;
i) rules for considering performance test results obtained before the entry into force of this regulation;
j) rules for considering performance test results obtained in the country of origin of imported individuals;
k) the rules for considering performance test results obtained at breeding dog shows not organized by the breeding organization, or at foreign breeding dog shows.
